Fuel Modules, Fuel Pumps Warranty
New Fuel Pump Assemblies (which includes Fuel Modules, Hanger Assemblies, Sender Assemblies), Electrical Fuel Pumps, Mechanical Fuel Pumps and Fuel Pump Strainers, as described herein (Parts) supplied by Spectra Premium Industries, shall carry a Limited Lifetime Warranty as described herein (Warranty) as of January 1st, 2014.
1. Limited Lifetime Warranty
1.1. Spectra Premium warrants every new Part to be free from defects in material and workmanship from the date of professional installation, as long as the original purchaser owns the vehicle in which it was installed, subject to the conditions detailed in this Warranty. Under this Warranty and subject to such conditions, every defective Part will be replaced by Spectra Premium, at no cost to Purchaser, following its return to Spectra Premium, or Spectra Premium’s authorized representative, together with the original bill of sale for such Part and proof of professional installation thereof.
1.2. This Warranty covers only those Parts supplied by Spectra Premium, and identified as such.
1.3. This Warranty does not apply to Parts which were:
1.3.1. Altered by any party other than Spectra Premium so as to, in the view of Spectra Premium, negatively effect the performance or function of the Part;
1.3.2. Subject to misuse, abuse, negligence or operating conditions other than those for which such Part was designed and intended;
1.3.3. Improperly installed;
1.3.4. Not used for their intended purpose;
1.3.5. Not installed with a new Fuel Pump Strainer (where applicable) and a new in-line Fuel Filter;
1.3.6. Installed in a vehicle where regular preventive maintenance recommended by the vehicle manufacturer was not performed as and when recommended;
1.3.7. Deemed by Spectra Premium defective as a result of contamination due to rust, dirt, debris or agents found in the system;
1.3.8. Deemed by Spectra Premium defective as result of external corrosion;
1.3.9. Returned to Spectra Premium without the Purchaser’s original bill of sale and proof of professional installation;
1.3.10. Sold or supplied by an entity other than Spectra Premium;
1.3.11. Installed on a vehicle on which the Fuel Tank Lock-Ring and/or O-Ring (where applicable) were not replaced at the same time as the Parts subject to a warranty claim;
1.3.12. Installed on a vehicle on which the Fuel Pump Strainer does not match the position of the original equipment being replaced.
1.3.13. Installed on a vehicle used for commercial purposes.
2. Replacement of Parts as sole remedy
Replacement of the Parts supplied by Spectra Premium shall be the only remedy available to a Purchaser under this Warranty. This Warranty does not cover any claims for, and Spectra Premium shall not be liable for, the original purchase price for the Parts, labour or material expenses of the Purchaser or any indirect, consequential or incidental damages of any kind resulting from use of the Parts by the Purchaser (such indirect, consequential or incidental damages include, without limitation, loss of the use of the vehicle, towing charges, rental of a replacement vehicle or any other indirect, special, incidental or consequential damages).
In the event that upon a Purchaser claiming under this Warranty, the Parts being returned by the Purchaser are no longer being supplied by Spectra Premium as of the date of receipt of the Parts by Spectra Premium, this Warranty shall be void and of no effect.
3.Warranty for Original Purchaser Only
This Warranty is for the sole benefit of and enforceable only by the first retail Purchaser of the Parts and is in lieu of all other warranties expressed or implied, including legal warranties. This Warranty is not transferable and is immediately voided in the event that the vehicle in which the Parts have been installed is sold, leased or otherwise transferred to another owner.
4.Warranty Claim
In order to claim replacement Parts pursuant to this Warranty, a Purchaser is required to deliver the Parts to their original place of purchase, together with the (i) original bill of purchase for the Parts listing also a new Fuel Pump Strainer (where applicable) and new in-line Fuel Filter and (ii) proof of professional installation of the Parts and of a new Fuel Pump Strainer (where applicable) and new in-line Fuel Filter.
Fuel Tank Assemblies Warranty
Spectra Premium warrants its fuel tank assemblies for a period of two years from the date of purchase.
Spectra Premium does not represent or warrant any product which is not used for its intended purpose, is improperly installed or is not used within normal conditions.
Spectra Premium’s liability shall be limited to the cost of replacing a defective product with the same terms and conditions as when initially sold.
Fuel Tank Straps Warranty
Spectra Premium warrants its straps for a period of one year from the date of purchase.
Spectra Premium does not represent or warrant any product which is not used for its intended purpose, is improperly installed or is not used within normal conditions.
Spectra Premium’s liability shall be limited to the cost of replacing a defective product with the same terms and conditions as wheninitially sold.
